Srinagar- Viewing non-compliance of its orders seriously, the High Court of J&K and Ladakh has issued bailable warrant against Registrar of University of Kashmir to secure his presence before it on June 12 in connection with a petition regarding regularization of 84 casual and contractual employees in the varsity.
Hearing a contempt petition filed by Sabiya Rashid and others, a bench of Justice Sanjeev Kumar observed that on April 28, the Court while giving two weeks further time to the university authorities to file compliance report in terms of order dated 26th August 2022, had made it clear that in case the needful was not done by the Registrar, he shall appear in person on the next date of hearing.
“As a matter of fact, there was a similar order passed by this Court on 31st March, 2023 also. The order dated 28th April, 2023, has been conveyed to the respondents (university authorities) by this Court. Despite the respondents having been served with the order, nobody has appeared on behalf of them,” the court said, adding, “In these circumstances, this Court is left with no option but to secure the presence of respondent No. 2-Registrar, University of Kashmir, Hazratbal, Srinagar, through bailable warrant to the tune of Rs. 10,000 to be executed through SHO Police Station Hazratbal Srinagar.” The court listed the petition for further consideration on June 12.
On 26th August last year, the court had observed that in terms of decision of the University Council taken in its meeting held on 05 June 2020, 84 supernumerary positions were designated as Helpers in the pay band of Rs.4440-7440 and the court had ordered that same deem to have been created w.e.f . 01.11.2018;
“The respondents (KU authorities) shall go ahead with the process of regularization of 84 casual/contractual engagees which include the petitioners against such posts/positions of Helpers and issue appropriate orders of regularization in favour of those who are found to have completed mandatory period of seven years of uninterrupted service and are otherwise found eligible in terms of University Notification dated 03.09.2014 (supra),” the court had said, adding, “The petitioners shall be entitled to their regularization with retrospective effect from the date they have attained the eligibility for such regularization i.e. 01.11.2018 and shall also be entitled to arrears of their salary. The court had also directed the varsity to complete the entire exercise, culminating into issuance of regularization orders in favour of eligible casual/contractual engagees within a period of two months.
