JAMMU – A special National Investigation Agency (NIA) court in Jammu on Saturday said there was enough evidence to prosecute Jammu and Kashmir Liberation Front (JKLF) chairman Muhammad Yasin Malik and six others over the killing of four Indian Air Force personnel in Kashmir in 1990.
The court said that prima facia there was enough evidence to prosecute all of them, reports said.
Special NIA judge Subhash Gupta said the court was of the certain view that sufficient grounds exist for drawing presumption that the accused Yasin Malik, Ali Mohammad Mir, Manzoor Ahmed Sofi, Javed Ahmed Mir, Saleem Nana Ji, Javed Ahmed Zarger and Shoukat Ahmed Bakhshi, prima facie have committed acts of militancy.
The order by Gupta stated, “Besides prosecution witnesses, sufficient grounds exist in drawing the presumption that the accused prima facie have committed officers under Sections 302, 307 RPC, Section 3(3) and Section 4(1) of TADA Act 1987 and Section 7/26 of Arms Act 1959 read with Section 120-B of Ranbir Penal Code.”
On January 25, 1990, four IAF employees, including Squadron Leader Ravi Khanna, were killed by militants in Rawalpora area of Srinagar.
Muhammad Yasin Malik is currently serving jail sentence in a ‘terror funding’ case by the National Investigative Agency and is lodged in Delhi’s Tihar Jail.
Apart from Nana ji, who was exempted from personal appearance today, the other accused in the case were present in court and were directed to be present for the next hearing as well.
The judge directed the jail superintendents to produce Yasin Malik and Showkat Ahmed Bakhshi, through video conferencing on March 16.
