SRINAGAR The State High Court on Monday directed Deputy Commissioner Kulgam to remove police station Qoimoh if the same was found to have been raised on an irrigation canal in southern Kashmir district.
Hearing a petition, a division bench of the court comprising Justices Ali Mohammad Magrey and Rashid Ali Dar passed the directions after being informed by advocate G A Lone that the deputy commissioner was asked to visit the spot where the police station was allegedly being constructed on the Irrigation canal (Kuhl) in Qoimoh Kulgam. Advocate Lone said that though the Deputy Commissioner responded to the courts directions has not taken steps to remove the alleged construction/encroachment.
Deputy Commissioner Kulgam shall ensure that no construction is raised on the irrigation canal/Kuhl and in case it is found that any construction is raised on the spot, the same shall be removed.
The court also asked senior additional advocate general B A Dar to file report about the laying of pipes in violation of the court orders at Malla Bagh Srinagar and submit report in this regard by next date of hearing on December 3.
The court has also directed respondents to file within four weeks status report with regard to its directions on Ramsar Convention on Wetlands.
The court has ordered there was need for preservation and maintenance of the wetlands which are covered under Ramsar Convention on Wetlands as directed by the Supreme Court of India as well as other 1230 Wetlands which have been so recognized and identified by the State Government in the Atlas prepared by the Department of Ecology, Environment and Remote Sensing of the Government of Jammu and Kashmir.
