Governor Takes Control, Suspends Assembly

SRINAGAR — Governor NN Vohra on Wednesday issued the Proclamation to impose Governor’s Rule under section 92 of the Constitution of Jammu and Kashmir, soon after receiving President Ram Nath Kovind’s approval. NN Vohra placed the legislative assembly under suspended animation.

The development came after President approved governor’s rule in the state with immediate effect.

Vohra has yesterday written to the president after the collapse of the elected government in the state following the pulling out of BJP from the ruling alliance. 

Soon after taking over, Vohra held a meeting with all the Administrative Secretaries and the senior most Police and Forest Service officers  at the Civil Secretariat here today. This was the Governor’s first visit to the Civil Secretariat after the imposition of Governor’s Rule in the State earlier today. 

Governor directed Administrative Secretaries and DGP to ensure that all Government functionaries attended office punctually and their presence is daily monitored through the Bio-metric attendance system; Administrative Secretaries shall personally review and ensure prompt and efficient delivery of various public services to the people of the State; complaints regarding delays, irregularities and corruption must be dealt with most sternly and those responsible should be proceeded against without any fear or favour.

Governor asked the Administrative Secretaries to send him reports regarding the to date progress of Prime Minister’s Development Programmes – 2015; causes of delay in the enactment of State legislation on the analogy of the Central Disability Act 2016; reasons of failure to implement the required measures for the conservation and cleanliness of the Dal Lake; implementation status of all flagship Central Schemes; status of construction of bunkers in villages located along the IB and LoC; timely payment of relief to the victims of border firing at IB/LOC; status of preparations for holding Panchayat and Municipal Elections; position regarding stocking and supply of food and other essential commodities by Food and Civil Supplies Department; to-date status regarding the writing of Annual Performance Reports and filing of Annual Property Returns by State Government officers; implementation status of LED Bulbs distribution all over the State for securing economy in the use of electricity; to-date position regarding compassionate appointment cases under SRO-43; implementation status of the Non-Functional (Monetary) Scheme (NFS) for KAS Officers; action taken with regard to the payment of salaries and issues faced by the SSA teachers; and other issues.

Governor asked Chief Secretary to have prepared by 21st June, 2018 department wise lists of all pending cases and forward the same to him with his remarks regarding the reasons for delay. He asked Chief Secretary to ensure that every important matter was timely disposed of and all cases which required higher level approvals should be sent to the Governor.

Governor expressed concern and directed Administrative Secretaries to ensure the timely utilisation of all available resources, particularly the funds available under the State Plan and the various Centrally Sponsored Schemes.

Earlier, on arrival at the Civil Secretariat, the Governor was received by B.B. Vyas, Chief Secretary, Dr. S.P Vaid, DGP and  R.K. Goyal, Principal Secretary, Home. Governor was accompanied by  Umang Narula, Principal Secretary to Governor.  

What Proclamation Means  

As the governor issued the proclamation for the governor’s rule in Jammu and Kashmir, the operation of provisions of the State Constitution relating to the allocation among the Ministers of the Business of the Government or the State were suspended

Also, the Legislative Assembly of the State shall remain under suspended animation till such time Proclamation is revoked or varied in this regard by a subsequent Proclamation ;

The Governor will prepare such Bills as may deem necessary and declare in respect of any Bill so prepared that he gave his assent thereto;  The Governor as often as he may deem it necessary and pending due appropriation by law, make, by notification in the Official Gazette, grants in advance in respect of the estimated expenditure or grants in respect of supplementary or additional expenditure for the period during the Proclamation may be or is in force, the grants for meeting any expected demands and exceptional grants which do not form part of the current service of the financial year. Any reference in the State Constitution to Acts or laws of or made by the Legislature of the State shall be construed as including a reference to Acts or laws made by governor.
