I&FC official convicted for corruption, sentenced for two years

SRINAGAR: Special Judge of Anti-Corruption today convicted Mohammad Amin Bhat of Watergam Baramullah, the then Chainman in the office of Collector land Acquisition for Irrigation and Flood Control, under the corruption case under FIR number 45/2006 of Police Station VOK.

On December 30, 2006, a case FIR No. 45/2006 P/S VOK under section 5(2) J&K Prevention of Corruption Act was registered against the accused in Police Station Vigilance Organization Kashmir on a written complaint lodged by one Ali Mohammad Bhat of Awantipora alleging therein that Mohammad Amin Bhat Chainman in the office of Collector Land Acquisition for Irrigation and Flood Control Srinagar was demanding Rs. 1500 as illegal gratification for processing his compensation case file which was lying pending and was unnecessary delayed on one or other pretext despite repeated requests by the complainant.

Immediately after Registration of the instant case, a team of officials of Vigilance headed by Dy. SP Bashir Ahmad Dar was constituted to lay the trap who caught the accused red handed while accepting an amount of Rs. 1500 as illegal gratification from the complainant.

The investigating Officer Inspector AR Mir after thorough investigation established Criminal Misconduct in terms of section 5(2) J&K P.C Act against the accused Mohammad Amin Bhat the then Chainman in the office of Collector Land Acquisition for Irrigation and Flood Control Srinagar.

After completion of investigation, the charge sheet was produced against the accused before the Court of Special Judge Anti-corruption Kashmir by vigilance Organization in the month of May 2007 and on conclusion of the trial by the Court of Special Judge Anti Corruption Kashmir Srinagar, the accused was found guilty and was convicted accordingly. The Court ordered the accused be sentenced to undergo two years imprisonment with fine of Rs. 10,000 for the commission of offence under section 5(2) J&K P.C Act and Six months imprisonment for commission of offence under Section 161 RPC and further imprisonment of three months in default of payment of fine.

The sentences awarded to accused however shall run concurrently.

After the announcement of the Judgment in the above said case, the accused was taken into custody and was sent to Central Jail Srinagar to undergo the sentence awarded. (PTK)
