Wamiq Farooq case shifted, father torches case papers

Srinagar: The Additional District and Session Judge Sham Lal Lalhal Tuesday transferred the much publicized Wamiq Farooq case to the court of Principal District and Session Judge Rashid Ali Dar, who is likely to hear the case on the next hearing listed on December 31.

On Tuesday when the case came up for the hearing in the court of Additional District and Session Judge (ADSJ), Counsel for the complainant Advocate Ajaz Ahmed Dar sought discussion on whether the accused cops already in judicial custody should be charged under section 302 or not.

The court directed the Counsel to start a discussion on the interim bail plea of the accused cops.    

 Without having any discussion the court ordered the transfer of the case to the court of Principal District and Session Judge Rashid Ali Dar. The case has been listed for the next hearing on December 31.

Shortly after the court proceedings were over, the complainant Farooq Ahmed staged a protest in the court premises and burnt down the papers related to the case. He alleged that court has already made up its mind to grant bail to the accused cops.

Wamiq, a class 7 student, was killed after a teargas shell fired allegedly by police hit him on the head near Gani Memorial Stadium at Rajouri Kadal Srinagar on January 31, 2010.The accused cops ASI Abdul Khaliq and constable Muhammad Akram are facing charges of ‘culpable homicide not amounting to murder’. 

Father torches case papers

The father of Wamiq Faooq Tuesday threatened to end his life in case court grants bail to the two accused cops. While setting all the court papers related to case on fire in the premises of Court Complex Bemina Srinagar, Farooq Ahmed staged a solitary protest alleging that court has made up its mind to grant bail to the accused cops.

“We all were shocked after the court informed my counsel that he is enacting a drama and is responsible for curtailing the liberty of the accused cops. Are we enacting a drama? I have lost my son and from last five years I have been moving from one court to another to get justice,” he told reporters.

He said that the court was supposed to discuss whether the accused cops should be charged under 302 or not. “It was strange that the court informed us to start a discussion on the bail of the accused cops,” he said.

“I had seen a ray of hope about the justice when the court sent the accused cops to jail. But today I lost that hope after the Court accused us of wasting his time,” he said.

Farooq Ahmed alleged that the court has made up its mind to grant the bail to the accused cops and if it did so, he will end his life. “What does the Court mean by saying that we have curtailed the liberty of these accused cops? These cops killed my son. My only fault is that I followed the system to seek justice for my son,” he said.   

Meanwhile, the 2nd Additional District and Session Judge has reportedly filed a complaint against Wamiq’s father and his council, saying that the duo has ‘threatened’ him.
